1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and the Company. We reserve the right to modify these Terms at any time. Your continued use of our services after any changes indicates your acceptance of the modified Terms.

2. Description of Service

Falzones Service, Inc. provides equipment repair, maintenance, diagnostic, and installation services for residential and commercial properties. Our services include but are not limited to:

  • Preventive maintenance programs
  • Installation of new equipment and systems
  • Emergency repair services
  • Commercial and residential service contracts

3. Eligibility

Pricing is subject to change without prior notice. We will communicate final pricing before beginning any work. Payment terms will be specified in the service agreement.

7. Intellectual Property

All content, materials, trademarks, and intellectual property associated with our services, including our website, logos, documentation, and methodologies, are the exclusive property of Falzones Service, Inc. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • Services will be uninterrupted or error-free
  • Equipment will operate without issues after service
  • Results will be achieved for any particular purpose

Any third-party products or services we recommend or install are subject to their respective manufacturer warranties.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FALZONES SERVICE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

We are not responsible for damages resulting from:

  • Pre-existing conditions or equipment failures
  • Improper use or maintenance after service
  • Acts of nature or circumstances beyond our control
  • Delays or failures caused by third parties
  • Your failure to follow recommended instructions

10. Third-Party Services and Links

11. Termination

We reserve the right to terminate or suspend services at any time, with or without cause, with or without notice. Upon termination:

  • All outstanding payments become immediately due
  • We may remove equipment or materials we have supplied
  • Any warranties or service guarantees may be voided
  • Provisions that should survive termination will remain in effect

You may cancel services according to the cancellation terms specified in your service agreement. Cancellation fees may apply.

12. Indemnification

You agree to indemnify and hold harmless Falzones Service, Inc., its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States of America, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Luzerne County, Pennsylvania.

14. Dispute Resolution

In the event of a dispute, we encourage you to contact us directly to seek resolution. If we cannot resolve the dispute informally, either party may pursue appropriate legal remedies in accordance with the governing law provisions.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, along with any service agreements and policies referenced herein, constitute the entire agreement between you and Falzones Service, Inc. regarding the use of our services and supersede any prior agreements.
